1. Acceptance of Terms

Welcome to Peppy! By downloading, installing, accessing, or using the Peppy mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App.

These Terms constitute a legally binding agreement between you and Peppy ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting in the App or on our website.

2. Description of Service

Peppy is a mobile application designed to deliver daily inspirational and motivational quotes to help users improve their mental well-being and build positive daily habits. Our services include:

• Access to curated inspirational quotes across 20+ categories including Motivation, Confidence, Anxiety Relief, Self-Love, Mindfulness, Success, Focus, and more
• Daily streak tracking to encourage consistent engagement
• Personalization features including custom backgrounds, themes, and app icons
• Push notifications for daily quote reminders
• iOS home screen widgets
• Ability to save and share favorite quotes
• Premium subscription features ("Peppy Pro")

3. User Eligibility

You must be at least 13 years of age to use Peppy. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

You may optionally provide a name for personalization purposes. You are responsible for maintaining the accuracy of any information you provide.

4. User Accounts and Data

Peppy allows you to personalize your experience by:

• Setting a display name
• Choosing preferred quote categories
• Saving liked quotes
• Configuring notification preferences

Most of your data is stored locally on your device. You are responsible for maintaining the security of your device and any data stored on it.

5. Subscription and Payments (Peppy Pro)

Peppy offers a premium subscription service called "Peppy Pro" that provides access to additional features including:

• Full library of custom backgrounds
• Premium app icon designs
• Custom quote mix creation
• Enhanced personalization options

5.1 Billing

Peppy Pro subscriptions are billed through the Apple App Store or Google Play Store, depending on your device. All billing, payment processing, and refunds are handled by the respective app store.

5.2 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

5.3 Cancellation

You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial subscription periods.

5.4 Price Changes

We reserve the right to change subscription pricing. Any price changes will be communicated in advance and will apply to subsequent billing periods.

6. User Content and Conduct

When using Peppy, you agree to:

• Use the App only for its intended purpose of personal inspiration and motivation
• Not use the App for any illegal or unauthorized purpose
• Not attempt to interfere with or disrupt the App's functionality
• Not reproduce, distribute, or commercially exploit any content from the App without permission
• Respect the intellectual property rights of Peppy and third parties

When sharing quotes, you agree to do so in a manner that does not violate any laws or infringe on the rights of others.

7. Intellectual Property

All content in the Peppy app, including but not limited to quotes, text, graphics, logos, icons, images, audio, software, and the compilation thereof, is the property of Peppy or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our content without written permission
• Use our trademarks, logos, or branding without authorization
• Reverse engineer, decompile, or disassemble any part of the App
• Create derivative works based on the App or its content

8. Disclaimers

Inspirational Content Only: The quotes and content provided in Peppy are for inspirational and motivational purposes only. They are not intended to be, and should not be construed as, professional advice of any kind, including but not limited to medical, psychological, therapeutic, financial, or legal advice.

Not a Substitute for Professional Help: Peppy is not a substitute for professional mental health services. If you are experiencing mental health issues, please consult with a qualified healthcare professional.

No Guarantees: We do not guarantee that the use of Peppy will result in any particular outcome or improvement in your mental well-being.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEPPY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code transmitted through the App
• Any errors or omissions in any content

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10. Indemnification

You agree to indemnify, defend, and hold harmless Peppy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.

You may stop using the App at any time by deleting it from your device. If you have a Peppy Pro subscription, remember to cancel it through your device's app store to avoid further charges.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms in the App or on our website. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Peppy operates, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
